1. INTRODUCTION
- These Wi-Fi On Board Terms & Conditions ("Wi-Fi Terms") govern the purchase and use of Wi-Fi connectivity services made available through the Attica Group sales channels.
- These Terms supplement the Company's Conditions of Carriage and the Ancillary Services Terms & Conditions.
- By purchasing or using a Wi-Fi package, the passenger accepts these Terms.
2. SERVICE PROVIDER
- The Wi-Fi On Board service is provided by Telenor Maritime AS or such other telecommunications provider as may be appointed by the Company from time to time ("Service Provider").
- The Company acts solely as: (a) booking platform; (b) distribution channel; (c) payment collection intermediary; for the Wi-Fi Service.
- The Company is not: (a) a provider of electronic communications services; (b) a telecommunications operator; (c) an internet service provider; (d) the operator of the onboard communications network.
3. DESCRIPTION OF THE SERVICE
- The Wi-Fi Service enables passengers to access internet connectivity through the onboard telecommunications infrastructure operated by the Service Provider.
- The Service is provided through maritime satellite and/or wireless communications systems.
- The Service is offered subject to technical and operational limitations inherent in maritime communications networks.
4. SERVICE AVAILABILITY
- Availability of the Service depends on multiple factors including: (a) vessel location; (b) route; (c) weather conditions; (d) satellite coverage; (e) bandwidth availability; (f) network congestion; (g) technical maintenance; (h) force majeure events.
- The Service Provider and the Company do not guarantee: (a) uninterrupted service; (b) continuous connectivity; (c) minimum bandwidth; (d) minimum speed; (e) uninterrupted access to specific websites or applications.
- Service quality may vary significantly during the voyage.
5. ACCEPTABLE USE POLICY
- The passenger shall not use the Service: (a) for unlawful purposes; (b) to distribute malicious software; (c) to engage in hacking or unauthorised access activities; (d) to infringe intellectual property rights; (e) to distribute unlawful, offensive or harmful content; (f) to interfere with network integrity or performance.
- The Service Provider may suspend or terminate access where misuse is reasonably suspected.
- Any suspension under this clause shall not entitle the passenger to a refund.
6. DEVICE COMPATIBILITY
- The passenger is solely responsible for ensuring that his/her device is capable of connecting to the Service.
- The Company and the Service Provider make no representation regarding compatibility with any specific device, operating system or application.
7 PURCHASE OF PACKAGES
- Wi-Fi packages may be purchased: (a) prior to departure; (b) during the booking process; (c) onboard the vessel; (d) through other authorised channels.
- Access credentials shall be issued following successful purchase and activation.
8. REFUND POLICY
- Refunds may be granted by the Service Provider where: (a) the purchased package cannot be activated; (b) access credentials are invalid; (c) the Service is unavailable due to a verified technical fault attributable to the Service Provider; (d) the voyage is cancelled before activation of the package.
- Refunds shall not be granted solely because: (a) connection speed is lower than expected; (b) signal strength fluctuates; (c) temporary interruptions occur; (d) the passenger's device is incompatible; (e) the passenger elects not to use the Service.
- Refund requests must be submitted within thirty (30) days from the date of travel.
9. LIABILITY
- The Wi-Fi On Board Service is provided by the Service Provider, which shall remain solely responsible for the provision, operation, quality, availability, safety, regulatory compliance and lawful operation of the Service.
- The Company acts solely as a booking platform, distribution channel and payment collection intermediary and shall not be deemed to be, nor act as, a provider of electronic communications services, an internet service provider or the operator of the onboard telecommunications network.
- The Company shall not be liable for: (a) any interruption, unavailability or degradation of the Service; (b) any network failure, malfunction or technical defect; (c) any loss of data or connectivity issues; (d) reduced connection speeds or bandwidth limitations; (e) any act, omission, negligence or breach of obligation by the Service Provider; (f) any loss, damage, cost or expense arising out of or in connection with the performance or non-performance of the Service by the Service Provider.
- Any claim relating to the provision, operation, quality, availability, safety or technical support of the Wi-Fi On Board Service shall, to the extent permitted by applicable law, be directed against the Service Provider responsible for providing such Service.
- The Company does not warrant or guarantee the availability, continuity, accessibility, performance, speed, quality or suitability of the Service for any particular purpose. The Service is provided subject to the technical, operational and geographical limitations inherent in maritime telecommunications networks.
- The Company shall remain responsible for the proper processing, transmission and administration of bookings and purchases of Wi-Fi packages made through its sales channels, in accordance with applicable law.
- Nothing in these Terms shall exclude, restrict or limit any liability which cannot lawfully be excluded, restricted or limited under applicable law.
10. LIMITATION OF LIABILITY
- The aggregate liability of the Company arising from the Wi-Fi Service shall not exceed the amount paid by the passenger for the relevant Wi-Fi package.
- Neither the Company nor the Service Provider shall be liable for: (a) indirect losses; (b) consequential losses; (c) loss of profits; (d) loss of business opportunities; (e) loss of data; (f) business interruption.
11. DATA PROTECTION
Τhe Company respects your personal data and is dedicated to its responsible handling. Please refer to the Privacy Notice which explains how we will use the information which you have provided to us.
Telenor Maritime AS, as the Internet service provider (ISP), is independently responsible for the data processing for the provision of internet access services via the on board Wi-Fi network, therefore please refer to this link for more information regarding the processing of your personal data. If You have reason to believe that your access to the Services is no longer secure (ex. loss, theft or unauthorised disclosure or use of usernames, passwords and personal identification numbers), you must promptly change the affected access information.
12. COMPLAINTS
Complaints relating to the Service may be submitted through the Company's customer service channels to the Service Provider.
- Technical complaints may be referred to the Service Provider for investigation and resolution.
13. GOVERNING LAW
These Terms shall be governed by Greek law. Any disputes shall be subject to the jurisdiction provisions contained in the Company's Conditions of Carriage.
