1. INTRODUCTION
- These Ancillary Services Terms & Conditions ("Terms") govern the purchase and use of optional ancillary services offered through the websites, mobile applications, reservation systems, ticket offices, call centers and other sales channels operated by Attica Group companies ("Company").
- These Terms apply in addition to the Company's Conditions of Carriage.
- In the event of conflict between these Terms and the Conditions of Carriage, these Terms shall prevail with respect to the Ancillary Service concerned.
2. DEFINITION OF ANCILLARY SERVICES
- Ancillary Services are optional services offered in connection with a passenger's ferry booking and do not form part of the transportation service itself.
- Ancillary Services may include:
- Any other optional service offered through the Company's sales channels
- Meals On Board
- Wi-Fi On Board
3. ROLE OF THE COMPANY
- Unless expressly stated otherwise, the Company acts solely as: booking platform; distribution channel; payment collection intermediary; for Ancillary Services provided by independent third-party service providers.
- The Company shall not be deemed to be: (a) provider of electronic communications services; (b) telecommunications operator; (c) internet service provider; (d) catering operator; or provider of any Ancillary Service supplied by a third-party provider.
- The identity of the relevant service provider shall be communicated to the passenger during the booking process and/or through the specific terms applicable to the service.
4. SEPARATE CONTRACTUAL RELATIONSHIP
- Purchase of an Ancillary Service give rise to a separate contractual relationship between the passenger and the relevant service provider.
- The transportation contract remains separate and independent from any Ancillary Service.
5. AVAILABILITY OF SERVICES
- Availability of Ancillary Services may depend on (a) vessel; (b) route; (c) operational requirements; (d) weather conditions; (e) technical limitations; (f) third-party provider availability.
- The Company does not guarantee uninterrupted availability of any Ancillary Service.
6. MODIFICATIONS
The Company reserves the right to modify, suspend or discontinue any Ancillary Service where reasonably required by (a) safety considerations; (b) operational requirements; (c) regulatory requirements; (d) actions or omissions of the third-party provider.
7. REFUNDS AND CANCELLATIONS
- Refund rights shall be governed by the specific terms applicable to each Ancillary Service.
- Unless otherwise expressly stated (a) cancellation of a ferry ticket shall not automatically cancel an Ancillary Service; (b) cancellation of an Ancillary Service shall not automatically affect a ferry ticket booking.
8. PASSENGER OBLIGATIONS
- Passengers shall provide accurate and complete information when purchasing an Ancillary Service.
- Passengers shall comply with any instructions issued by the relevant service provider.
9. LIABILITY
- The relevant Ancillary Service is provided by the applicable third-party service provider, which shall remain solely responsible for the provision, performance, quality, availability, safety, regulatory compliance and lawful operation of such service.
- The Company acts solely as a booking, distribution and payment collection intermediary and shall not be deemed to be the provider of the relevant Ancillary Service unless expressly stated otherwise.
- The Company shall not be liable for:
(a) service interruptions, unavailability or degradation of service;
(b) delays in the provision of the service;
(c) technical failures, system errors or connectivity issues;
(d) acts, omissions, negligence or default of any third-party service provider;
(e) the quality, suitability, safety or performance of services or products supplied by third-party service providers;
(f) losses, damages or expenses arising from the performance or non-performance of an Ancillary Service by a third-party provider.
Any claim relating to the provision, performance, quality, availability or safety of an Ancillary Service shall, be directed against the relevant service provider responsible for such service.
10. LIMITATION OF LIABILITY
To the extent permitted by applicable law, the Company's aggregate liability arising out of an Ancillary Service shall not exceed the amount paid by the passenger for the relevant Ancillary Service.

12. COMPLAINTS
Complaints relating to an Ancillary Service should be submitted through the Company's customer service channels or directly to the relevant service provider where applicable.
13. GOVERNING LAW
These Terms shall be governed by Greek law. Any disputes shall be subject to the jurisdiction provisions set out in the Company's Conditions of Carriage.
